1. WHAT IS THIS DOCUMENT?

1.1 This privacy policy (“Privacy Policy”) sets out the privacy terms and conditions of your use of the website www.aispeco.com (the “Website”) in relation to our processing of personal data and our Company’s rules for the processing of your personal data (the “Rules”).

1.2 Please read this Privacy Policy carefully so that you understand our practices when processing your personal data. By reading this document, you will know how we process your personal data, where we obtain it from and what your rights are as a personal data subject.

1.3 If you use the Website, purchase our services or are otherwise associated with our Company’s activities, you have read and agreed to this Privacy Policy and the purposes, methods and procedures for the processing of your personal data as set out herein. If you do not agree with the Privacy Policy or its individual terms, please contact us by phone or email and we will provide you with all necessary information.

1.4 For the purposes of this Privacy Policy, “personal data” means any information from which you can be identified, whether directly or indirectly. Personal data includes name, surname, date of birth, postal or email address, location data and internet identifier, characteristics specific to you, etc.

1.5 The provisions of this Privacy Policy apply to our customers who have purchased, are purchasing, or intend to purchase goods or services sold by us, our business partners (including their employees), and to persons who contact us with requests, requirements, either directly or by means of remote communication (telephone, email, social network accounts, etc.). This Privacy Policy applies to all persons who visit the Site, regardless of whether you are our customer, and to actions you may take on the Site. The Privacy Policy also contains information about the processing of personal data of all other persons by us in the course of our business and the conclusion and performance of contracts.

2.1 We are AISPECO, UAB, legal entity code 305584971, registered office address Slucko g. 8, Vilnius, website www.aispeco.com (hereinafter referred to as the “Company” and/or “Data Controller”).

3. WHAT PRINCIPLES DO WE FOLLOW?

3.1 In processing your personal data we:

3.1.1. comply with the requirements of applicable and valid legislation, including the GDPR;

3.1.2. process your personal data in a lawful, fair and transparent manner;

3.1.3. we will collect your personal data for specified, clearly defined and legitimate purposes and will not further process it in a way that is incompatible with those purposes, except to the extent permitted by law;

3.1.4. we will take all reasonable steps to ensure that personal data which are not accurate or complete in relation to the purposes for which they are processed are rectified, supplemented, suspended or destroyed without delay;

3.1.5. we will keep them in a form which permits identification of you for no longer than is necessary for the purposes for which the personal data are processed;

3.1.6. we will not provide personal data to third parties or disclose it to the public, except as provided in the Privacy Policy, the Terms and Conditions, or as required by law;

3.1.7. we will ensure that your personal data is processed in such a way as to ensure, by appropriate technical or organisational measures, adequate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage.

4. FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

4.1 We process your personal data for the following purposes:

4.1.1. for the purpose of manufacturing equipment and for the purpose of concluding, executing and accounting for sales and purchase contracts: Customer’s name, personal identification number/date of birth, telephone number, email address.

The Company may additionally process the following data of employees of legal entities (business partners of the Company): work telephone number, work e-mail address, workplace address, position held, authorisation/representation data, name of workplace, correspondence with the Company on behalf of or in the interests of the business partner, or other data provided during the conclusion of a contract with the Company, during the performance of the contract (signing of documents, confirmation of orders, etc.), or on other grounds relating to business relations;

In contractual relations, the data of business partners shall be stored for the entire period of validity of the contract and/or cooperation and for 10 (ten) years from the end of the contract and/or cooperation, if no other period of retention of Personal Data has been established by the laws of the Republic of Lithuania.

For this purpose, we receive your personal data from: yourself, business partners, third parties.

4.1.2. for the purpose of submitting and responding to an enquiry/question and for the purpose of resolving potential or arising disputes with data subjects. When you contact us (or we contact you following your enquiry), we process information from telephone, email, Website or other communications. 

For this purpose, we process the following personal data about you: name, surname, email address, telephone number, content of the complaint and/or enquiry, telephone number, date and time of the contact, details of the communication, content of the comment you wish to make public.

For this purpose, we obtain your personal data: from you yourself, we may create personal data ourselves in the course of fulfilling a query or analysing a complaint (e.g., after receiving your complaint, we contact third parties about the facts and record them, etc.).

For this purpose, we keep your data for 3 years from the date of recording, unless there are grounds to believe that a crime or other illegal act has been recorded or an internal investigation has been launched, until the end of the relevant investigation and/or proceedings.

4.1.3. for direct marketing purposes. For this purpose, we process your name, surname, telephone number, e-mail address, data of customers (legal entities), representatives (employees) of business partners or other contact persons: work telephone number, work e-mail address, workplace address, position held.

For this purpose, we obtain your personal data from: yourself.

For this purpose, we store your data for the duration of your consent. 

Consent may be withdrawn at any time.

4.1.4. for the purpose of debt management. For this purpose, we process your name, residential address, payment information, the basis and amount of the debt, telephone number, e-mail address.

For this purpose, we obtain your personal data directly from you, from publicly available sources (e.g. population register, data provided by third parties, etc.) and from third parties.

For this purpose, we provide or transfer your data to (1) law enforcement authorities and/or (2) debt collection service providers.

For this purpose, we store your data until the end of the administration of the debt (debt liquidation) and in accordance with the limitation period of 10 years set by the Civil Code of the Republic of Lithuania.

5. HOW DO WE COLLECT AND PROCESS YOUR PERSONAL DATA?

5.1 We process your personal data obtained in the following ways:

5.1.1. when you provide it to us.

5.1.2 When you use the Website operated by us, certain information (e.g. Internet Protocol (IP) address, etc.) is collected automatically.

5.1.3. when we receive your personal data from other persons in accordance with the procedure established by law and/or this Privacy Policy.

5.2 You provide us with your personal data and other information by using the Sites, by writing to us or communicating with our customer service team, by making enquiries and/or submitting your complaints about the Site or the services we provide, the goods we sell, or by subscribing to our newsletter. If you contact us in writing or by e-mail, we will keep the details of the correspondence.

5.3 The information you provide may include your name, email address and telephone number, the text of the message (e.g. when registering for a consultation) and other details.

5.4 When you use the Website, certain non-personal information (e.g. type of web browser used, number of visits, pages viewed on the Website, time spent on the Website, etc.) is collected automatically. This information is used to improve the content, functionality and attractiveness of the Site.

5.5 We may combine the personal data we receive from you with our own data collected from other public and/or accessible sources (e.g., we may combine the personal data you provide with data obtained through the use of the Site’s cookies or with data lawfully obtained from third parties, etc.).

5.6 You will always be able to request the rectification of erroneous personal data and to exercise your other rights as a personal data subject as set out in this Privacy Policy and in applicable law.

6. DO WE USE YOUR PERSONAL DATA FOR DIRECT MARKETING?

6.1 Yes, we may use your personal data for the purpose of direct marketing in order to provide you with offers and information about our services that we think may be of interest to you. However, we will only use your personal data for this purpose with your further consent.

6.2 For this purpose, we process the following personal data about you: name, surname, telephone number, e-mail address, data of customers (legal entities), representatives (employees) of business partners or other contact persons: work telephone number, work e-mail address, workplace address, position held.

6.3 You can choose whether to allow us to use your personal data for direct marketing purposes. You can do this by giving your consent.

6.4 By giving us the right to process your data for direct marketing purposes, you also give us permission to contact you for this purpose by means of communication (e.g. email, telephone, SMS) or other means of communication (e.g. social media accounts).

6.5 We may combine the information we hold about you with information held by third parties in order to make offers to you.

6.6 If you consent to the use of your personal data for direct marketing purposes, we may use your personal data to analyse and improve the effectiveness of our websites, advertising and market research, and for other marketing and sales purposes of the Company. In this case, we will use your personalised data.

6.7 Even if you have given your consent to the processing of your personal data for direct marketing purposes, you can easily withdraw this consent at any time for all or part of the processing activities. You can do this in the following ways:

6.7.1. by notifying your unsubscribe in the manner indicated in the email communications and/or offers you receive (e.g. by clicking on the “unsubscribe” link in the newsletter, etc.), or

6.7.2. by coming to us and making a request. You must clearly state your name in your request. If you wish to withdraw your consent in this way, we may ask you to provide proof of identity.

6.8 The processing of your personal data for the purpose of direct marketing shall be terminated at the latest within 3 days of receipt of the request.

6.9 Withdrawal of consent does not automatically oblige us to destroy your personal data or to provide you with information about our processing of your personal data, and if you wish us to carry out these actions as well, you must make such request separately.

7. WHO DO WE PROVIDE YOUR PERSONAL DATA TO?

7.1 We warrant that your personal data will not be sold, provided or otherwise transferred to third parties without lawful basis, nor will it be used for purposes other than those for which the relevant personal data was collected. We will not transfer your personal data in any way other than in accordance with this Privacy Policy and the law. However, we reserve the right to disclose information about you if we are required to do so by law or if we are requested to do so by lawful authorities or prosecuting authorities.

7.2 We may disclose the data we collect about you to the following third parties:

7.2.1. third party service providers (e.g. technical service providers in the performance of our contracts with these service providers, including the performance of services for sending newsletters or other marketing activities).

7.2.2. to third party service providers whose services we generally use for data storage, telecommunications and website hosting purposes.

7.3 The above service providers are limited in their ability to use your data and may not use it for purposes other than to provide services to us.

8. HOW DO WE STORE YOUR PERSONAL DATA?

8.1 The data we collect from you will be located within the EU, but may be transferred or stored outside the EU. It may also be processed by our or our suppliers’ staff working outside the EU. When we transfer your data outside the EU, we will take all reasonable steps to ensure that your data is processed securely and in accordance with this Privacy Policy.

8.2 Unfortunately, the transmission of information over the internet is not completely secure. Although we take great care to protect your personal data, we cannot guarantee the security of the data when you transmit data to the Website – you assume the risks associated with the transmission of data to the Website. Once we receive your data, we will apply strict procedures and security measures to protect your data from unauthorised access.

8.3 In the unlikely event that we become aware of a breach of security of your personal data which may pose a significant threat to your rights or freedoms, we will notify you immediately upon becoming aware of it and determining what information has been accessed.

9.1 The Website may contain links to external websites, such as the websites of our business partners or websites that advertise services. If you follow such links to any of these sites, please note that these sites and the services available through them have their own separate privacy policies and we do not accept any responsibility or liability for these policies or for the personal data, such as contact or location data, collected by these sites or services. Please review these policies before submitting personal data to these websites or using any services.

10. WHAT RIGHTS DO YOU HAVE?

10.1 When processing personal data, we ensure your rights in accordance with the GDPR and the Law on Legal Protection of Personal Data of the Republic of Lithuania. As a data subject you have the following rights:

10.1.1. to know (be informed) about the processing of your personal data;

10.1.2. to have access to your personal data that we process;

10.1.3. to request the rectification or supplementation of, or the correction of, inaccurate or incomplete personal data concerning you;

10.1.4. request the destruction of personal data when it is no longer necessary for the purposes for which it was collected;

10.1.5. to request the destruction of personal data if they are processed unlawfully or if you withdraw or withhold your consent to the processing of personal data, which is necessary;

10.1.6. to object to the processing of your personal data or to withdraw your prior consent;

10.1.7. to request the suspension (other than storage) of the processing of your personal data in the event of disputes or to verify the lawfulness of the processing, the accuracy of the data, or where we no longer need your personal data, but you do not want us to delete it;

10.1.8. to request that, where technically feasible, your personal data collected pursuant to your consent or for the purposes of the performance of a contract be made available to you in an easily readable format or to request that it be transferred to another data controller.

10.2 We will endeavour to guarantee the exercise of your rights as a data subject and to provide all the conditions for the effective exercise of those rights, but we reserve the right not to comply with your requests where necessary to ensure

10.2.1. compliance with legal obligations imposed on us;

10.2.2. national security or defence;

10.2.3. public order, or the prevention, investigation, detection or prosecution of criminal offences;

10.2.4. important economic or financial interests of the State;

10.2.5. the prevention, investigation and detection of breaches of official or professional ethics;

10.2.6. the protection of your rights and freedoms or the rights and freedoms of others.

10.3 You may submit claims relating to the exercise of your rights to us in person, by post or by electronic communication. Upon receipt of your request, we may ask you to provide proof of identity, as well as other additional information we require in connection with your request.

10.4 Upon receipt of your request, we will respond to you no later than 30 calendar days from the date of receipt of your request and the submission of all the documents necessary to respond.

10.5 If we deem it necessary, we will suspend the processing of your data, other than storage, until your request is resolved. If you lawfully withdraw your consent, we will cease processing your personal data immediately, but not later than 30 calendar days, except in the cases set out in this Privacy Policy and by law, i.e. where we are obliged to continue to process your personal data by applicable law, by a legal obligation incumbent on us, by a judicial decision or by a binding order from the authorities.

10.6 If we refuse to comply with your request, we will clearly state the grounds for such refusal.

10.7 If you disagree with our actions or our response to your request, you may complain about our actions and decisions to a competent public authority.

11. WHO CAN YOU COMPLAIN TO?

11.1 If you wish to make a complaint about our processing of your data, please make it in writing, providing as much information as possible, using the contact details at the end of this Privacy Policy. We will co-operate with you and endeavour to resolve any issues promptly.

11.2 If you believe that your rights have been violated in accordance with the GDPR/other applicable personal data protection legislation, you may lodge a complaint with our supervisory authority, the State Data Protection Inspectorate of the Republic of Lithuania, where you can find more information and contact details on the Inspectorate’s website (https://vdai.lrv.lt/). Although we will first try to resolve any disputes together with you.

12. HOW WILL THIS PRIVACY POLICY BE AMENDED?

12.1 Any changes to our Privacy Policy will be posted on the Sites we operate. In the event of a material change and/or need, we will notify you of the change. The new terms of the Privacy Policy may also be posted on the Sites and you may need to read and agree to them in order to continue using the Site and/or our services, purchase the goods for sale, services provided.
